This website (hereinafter the "Site") is published and operated by BOLSINO ("we", "us", "our"). BOLSINO offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated herein.

 

1. ACCEPTANCE OF TERMS

The following terms of service, known as "Terms," govern the use of the BOLSINO websites, services, and communications available on the website, provided by BOLSINO, including accessing or viewing materials online, and any other engagement with BOLSINO both online and offline, such as when you interact with our customer service team. These services are owned and operated by BOLSINO, and any reference to "Services" includes all parts or components of it.

 

Please note that the Refund Policy, Shipping Policy, etc. are displayed on our website which may be amended from time to time, provide additional terms governing the purchase of products through the Services, and are incorporated in these Terms by reference. These policies mention that BOLSINO does not have its own refund/return, cancellation, and shipping policies. Therefore, to check a specific policy in terms of purchase of a product, you have to refer to the vendor’s or retailer’s policies whose product you are buying from the Site.  

 

BOLSINO provides the Services for personal use only. By using the Services, you agree to these Terms between you and BOLSINO. We have made every effort to display as accurately as reasonably possible the colors and images of our products that appear at the store. We cannot guarantee that your computer’s monitor's display of any color will be accurate.

We may choose to limit the sale of our products or Services to specific individuals, regions, or jurisdictions, but this is not an obligation. Such limitations will be decided on a case-by-case basis. Additionally, we reserve the right to restrict the quantities of products or Services we offer. You agree that BOLSINO will not be held responsible for any changes, suspensions or discontinuations of the Services we provide, either to you or any other person.

 

1. PURCHASE CONDITIONS

BOLSINO serves as a platform to display certain products and promotions that are or have been offered by a vendor or retailer website. BOLSINO does not intervene in the purchasing process, and hence, it does not cancel any orders or send cancellation notifications to the user. Any details related to purchases, cancellations, returns and refunds, and shipments are governed by the retailer’s or vendor’s respective policies available at their respective websites for which BOLSINO takes no responsibility.

Accuracy of Product Information:

BOLSINO exercises diligent care in sourcing product information from vendors and retailers. However, we expressly disclaim any warranty, express or implied, regarding the accuracy, reliability, or completeness of any product information on our website. This includes, but is not limited to, product titles, descriptions, and additional details. All such information is directly obtained from the listings of respective retailers, vendors, or brands. By using BOLSINO's services, users acknowledge and accept that discrepancies in product information may occur. BOLSINO expressly disclaims liability for any inaccuracies, errors, or misrepresentations in any product listings and shall not be liable for any claims, damages, or losses resulting therefrom.

Availability

Please note that BOLSINO cannot guarantee the availability of a product listed on the Site. Although we update product listings regularly, there are instances where a product may be out of stock or delisted on the vendor's/retailer's website while the product listing on the Site is not yet updated.

 

Price

The prices displayed on BOLSINO are sourced from the retailer or vendor's website. Although we update the prices regularly, we cannot guarantee that the price listed on the Site is the most current price of the product. The availability of any of the listed products at the price mentioned on BOLSINO is not guaranteed. It is possible that the price of a product may change and these updates may not be reflected on the Site. In such cases, users are not entitled to claim a specific product at a specific price.

 

Shipping

As per the Shipping Policy displayed on the Site, individual retailer/vendor is solely responsible for the shipping of their products purchased through the Services. Therefore, BOLSINO shall not be held responsible for any delays, damages, or losses that may arise during the shipping of products purchased through the Services.

 

Refund/Return

 

If you wish to return or exchange a product purchased through the Services, please note that BOLSINO does not have a refund policy. Instead, you will be subject to the refund policy of the relevant vendor or retailer from whom you purchased the product using the Services. It is your responsibility to review and understand the refund policy of the vendor or retailer from whom you purchased the product. By using the Services, you agree to be bound by the refund policy of the relevant vendor or retailer, and you release BOLSINO from any liability related to the refund of any product purchased through the Services.

Currency Conversion and Price Fluctuations

Prices on BOLSINO.com are initially quoted in United States Dollars (USD) and may be converted to other currencies such as Great British Pounds (GBP), Euros (EUR), or other applicable currencies for user convenience. Users acknowledge and agree that these currency conversions are approximate and subject to fluctuating exchange rates. BOLSINO utilizes available exchange rate information for these conversions but makes no representations or warranties regarding the accuracy or timeliness of such conversions. The currency conversion rules and rates applied by BOLSINO may not correspond to those used by the respective retailer, vendor, or brand. BOLSINO shall not be liable for any discrepancies, inaccuracies, or variances in prices due to exchange rate fluctuations, nor shall users have any right or claim against BOLSINO for products based on such pricing discrepancies.

 

1. RESTRICTED CONDUCT

Except as otherwise expressly authorized in these Terms, you agree not to do any of the following:

• Interfere with or disrupt the operation of the Services or others’ use of the Services in any way (including without limitation by hacking or defacing any portion of the Services);
• Modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Services, or reproduce, duplicate, sublicense, copy, sell, resell, distribute, assign, or otherwise exploit for any commercial purposes, any portion of, use of, or access to the Services;

1. OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

1. USER CONTENT

The user is assigning all their rights, interests, and benefits related to their Intellectual Property for all the content they post on the site, including product reviews, comments or suggestions, photographs, illustrations, artwork, videos, communications, and other materials uploaded by the user ("User Content"). The term "Intellectual Property" includes works of authorship, copyrights, moral rights, inventions, developments, concepts, improvements, designs, discoveries, know-how, ideas, software, trade secrets, and compositions of matter and trade secrets (whether or not protectable under trade secrets law, patentable or registrable under patent, copyright or similar laws), patent rights, and any other intellectual property rights anywhere in the world.

 

The user represents and warrants that they exclusively own any User Content posted by them and that they have all necessary rights to post such User Content via our Services, including the right to assign the Intellectual Property rights in such User Content to BOLSINO. The user also guarantees that any User Content they post, publish, display, or transmit to others via our Services complies with applicable law.

 

BOLSINO may monitor or review any User Content but are not obligated to do so unless required by law. BOLSINO retains the right to remove any or all User Content for any or no reason, including User Content that, in their sole discretion, violates these Terms. BOLSINO is and shall be under no obligation (1) to maintain any User Content in confidence; (2) to pay compensation for User Content; or (3) to respond to any User Content.

All names, graphics, designs, page headers, button icons, scripts, commercial markings, trade dress, service names, service marks, and logos used and displayed in connection with the Services are trademarks of BOLSINO or its licensors or suppliers/vendors (collectively, the “Trademarks”).  The Trademarks may not be used to disparage or discredit BOLSINO, any third party of BOLSINO’s or any third party products or services, or in any manner (in BOLSINO’s sole judgment, where permitted by law) that may damage any goodwill in the Trademarks or may cause confusion.

   INDEMNITY

To the extent permitted by law, you agree to defend, indemnify and hold BOLSINO and its respective affiliates, licensors, officers, directors, employees, agents, and representatives, harmless from any and all losses, costs, expenses or damage of any nature whatsoever, including, without limitation attorneys’ fees and court costs, arising from any claim, cause of action, demand or suit by any third party, related to or arising out of your use of the Services or violation of these Terms.  BOLSINO reserves the right to assume the exclusive defense and control of any matter which is subject to indemnification under this Section, and in such case, you agree to cooperate with all reasonable requests in assisting BOLSINO’s defense of such matter.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

BOLSINO may terminate or block your use of our Services if you violate these Terms or are engaged in illegal or fraudulent use of the Services.  Where permitted by law, you agree that any termination of your use of the Services may be effected without prior notice and you will remain liable for all amounts due up to and including the date of termination; Further, you agree that, to the maximum extent permitted by law, BOLSINO shall not be liable to you or any third party for any termination of your use or otherwise access to the Services.

The Services and all Site content, or any other feature, content or functionalities associated with the services, are provided on an “as is” and “as available” basis without warranty of any kind.  BOLSINO does not guarantee, represent, or warrant that your use of the services will be uninterrupted, timely, secure, or error free. BOLSINO hereby expressly disclaims all warranties or conditions of any kind, express or implied, including, but not limited to, implied warranties of merchantability, title, non-infringement, and fitness for a particular purpose.  BOLSINO makes no warranty that: (i) the services will meet your requirements, (ii) the quality, safety or legality of any content, products, services, information or other material accessed by you through the Services, or the services themselves (or any part thereof), will meet your expectations, or (iii) any errors in the services will be corrected. 

 

1. LIMITATION OF LIABILITY REGARDING SERVICES

TO THE EXTENT PERMITTED BY LAW,  BOLSINO SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES OR UNDER ANY LEGAL THEORY, WHETHER IN TORT, CONTRACT, OR OTHERWISE, WITH RESPECT TO THE SERVICES, OR ANY OTHER SUBJECT MATTER OF THESE TERMS, FOR: (I) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF BOLSINO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) SHALL BE LIMITED TO 1% OF THE PURCHASE PRICE OF THE PRODUCT THAT GAVE RISE TO THE CLAIM, REGARDLESS OF WHETHER THE CLAIM IS BASED IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

THIS LIMITATION OF LIABILITY SHALL ALSO APPLY TO ANY CLAIMS AGAINST BOLSINO DUE TO THE ACTS OR OMISSIONS OF ANY THIRD-PARTY SERVICE PROVIDERS, VENDORS, OR OTHER AFFILIATES, WHETHER SUCH CLAIMS ARE DIRECT OR INDIRECT. BOLSINO IS NOT AFFILIATED WITH, AND HAS NO AGENCY OR EMPLOYMENT RELATIONSHIP WITH, ANY THIRD-PARTY SERVICE PROVIDER USED IN CONJUNCTION WITH THE SERVICES. THEREFORE, BOLSINO DISCLAIMS ALL LIABILITY ARISING FROM THE ACTS OR OMISSIONS OF ANY SUCH THIRD-PARTY SERVICE PROVIDER.

 

1. RELEASE

 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOLSINO AND EACH OF ITS AFFILIATES, SUBSIDIARIES, DIVISIONS, PARENT AND RELATED COMPANIES (COLLECTIVELY, THE “RELEASEES”) WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR RELATING TO THE USE OR THE INABILITY TO USE THE SERVICES, ITS CONTENT OR LINKS, INCLUDING BUT NOT LIMITED TO DAMAGES CAUSED BY OR RELATED TO ERRORS, OMISSIONS, INTERRUPTIONS, DEFECTS, DELAY IN OPERATION OR TRANSMISSION, OR ANY COMPUTER VIRUS OR LINE FAILURE.  TO THE EXTENT PERMITTED BY LAW, RELEASEES WILL ALSO NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, EVEN IF WE OR THEY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. RELEASEES SHALL NOT HAVE ANY LIABILITY OR RESPONSIBILITY FOR ANY ACTS, OMISSIONS OR CONDUCT OF ANY USER OR OTHER THIRD PARTY.

 

1. WARRANTY

 

Certain products sold by BOLSINO may have warranties provided by the manufacturer of these products but not by BOLSINO or its affiliates. BOLSINO disclaims all warranties and conditions of any kind, whether express or implied, relating to any products sold by them through the Site. Additionally, the exclusion and limitation of liability shall apply to the fullest extent permitted by law, and BOLSINO or its affiliates shall not be liable for any damages or losses arising from any purchase made through their Services. It is the user’s responsibility to familiarize themselves with the vendor’s or retailor's relevant policies such as refund/return policy, cancellation policy, shipment policy, etc.  

The individual retailer/vendor is solely responsible for the shipping of products purchased through the Services. Therefore, BOLSINO shall not be held responsible for any delays, damages, or losses that may arise during the shipping of products that are purchased through the Services.

In addition, it is important to note that BOLSINO showcases the product listings, but does not guarantee the completeness or accuracy of the products, their availability, or prices. Therefore, any purchase made through the Services should be done at your own discretion and risk.

Therefore, if a product is unavailable, delayed, returned or exchanged, the vendor/retailer's policies available at their own websites will be used, and BOLSINO will not be liable for any direct, indirect, incidental, special, or consequential damages or delays arising from or in any way connected with any purchase made through their Services.

 

1. MINORS 

You confirm that you have reached the age of majority in your jurisdiction. If you are under the age of majority in your jurisdiction, you should not use our Services, register on this Website or otherwise provide any data without the permission of your parent or guardian. 

To the extent permitted by law, if you are the parent or guardian of a child under the age of majority, you should carefully supervise your child’s use of the Services on our Website. It is the responsibility of parents or guardians, and not BOLSINO, to determine whether any part of this Site or any site linked to from this Website is appropriate for their children.

If you are under the age of majority in your jurisdiction and you have entered into these Terms without the permission of your parent or legal guardian, then you or your parent or legal guardian may cancel your agreement to these Terms. 

1. APPLICABLE LAW AND ARBITRATION

The arbitration agreement is governed by the laws of Luxembourg.

In the event of any dispute, claim, question, or disagreement arising from or relating to these Terms of Service or the breach thereof, the parties hereto shall use their best efforts to settle such disputes, claims, questions, or disagreements. To this effect, they shall consult and negotiate with each other in good faith and, recognizing their mutual interests, attempt to reach a just and equitable solution satisfactory to both parties. If they do not reach such solution within a period of 60 days, then, upon notice by either party to the other, disputes, claims, questions, or disagreements shall be finally settled by arbitration administered by the Luxembourg Chamber of Commerce under its Rules of Arbitration, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

The arbitration will take place in Luxembourg. The arbitration will be conducted confidentially by a single arbitrator in accordance with the rules of the Luxembourg Chamber of Commerce.

The party initiating arbitration shall pay any initial filing fee required by the Luxembourg Chamber of Commerce. Each party will be responsible for paying any filing, administrative, and arbitrator fees associated with the arbitration. However, BOLSINO may choose to pay for any such fees on behalf of the user.

You understand and agree that all claims must be brought in your individual capacity, and not as a plaintiff or class member in any purported class action or representative proceeding, and, unless both you and BOLSINO agree otherwise, the arbitrator may not consolidate more than one person's claims.

1. ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

 

1. SEVERABILITY

To the extent permitted by law, where a specific clause of these Terms is declared null, that clause shall be deemed unwritten. However, to the extent permitted by law, this does not invalidate the successful registration of a user, the entire Terms, or any other terms and conditions accepted by the Customer.
